The United States has officially finalised a major immigration policy that replaces the long-standing “duration of status” (D/S) system for international students with fixed visa time limits. The US student visa rule, announced by the Department of Homeland Security (DHS), has triggered widespread concern among university leaders, immigration experts, and education organisations, who warn it could create new administrative burdens and discourage international students from choosing the US as a study destination.
Fixed Time Limits Replace Duration of Status
Under the new US student visa rule, effective September 15, 2026, most F-1 and J-1 visa holders will no longer be allowed to remain in the country for the duration of their academic programme. Instead, students will generally receive permission to stay for a fixed period of up to four years and must apply for an extension if their studies continue beyond that timeframe.
Additionally, the regulation curtails the grace period of F-1 students from 60 days to 30 days after completion of studies and puts stringent conditions on programme transfer and institutional transfer. The DHS has come out in support of these changes, stating that these changes will improve immigration control and decrease visa fraud.
Universities Question the Need for the Policy
Leaders in higher education have been highly critical of the student visa regulation in the United States, claiming that foreign students are one of the most scrutinized groups through the use of the Student and Exchange Visitor Information System (SEVIS).
